Welcome to Macrotracker. Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies, and obligations. By accessing or using the Macrotracker website or mobile application (collectively, the "Service"), you agree to comply with and be bound by these Terms.

If you do not agree to these Terms, please do not access or use our Service.

To use certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

The Service and its content, features, and functionality are owned by Macrotracker and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any right, title, or interest in the Service, others' content on the Service, or Macrotracker trademarks, logos, or other brand features.

We may, in our sole discretion, permit you to post, upload, publish, submit, or transmit content ("User Content"). By making available any User Content on or through the Service, you grant to Macrotracker a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, access, view, and otherwise exploit such User Content on, through, or by means of the Service.

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights to post the User Content and that doing so will not violate any law or the rights of any person.

The service is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Macrotracker does not warrant that the service is free of viruses or other harmful components.

To the maximum extent permitted by applicable law, Macrotracker shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party on the service; (c) any content obtained from the service; or (d) unauthorized access, use, or alteration of your transmissions or content.

In no event shall Macrotracker's aggregate liability for all claims relating to the service exceed one hundred U.S. dollars (U.S. $100.00).

You agree to defend, indemnify, and hold harmless Macrotracker and its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

We may terminate or suspend your access to and use of the Service, at our sole discretion, at any time and without notice to you. You may cancel your account at any time by contacting us at support@macrotracker.com. Upon any termination, discontinuation, or cancellation of the Service or your account, all provisions of these Terms which by their nature should survive will survive, including, without limitation, ownership provisions, warranty disclaimers, limitations of liability, and dispute resolution provisions.

We may revise these Terms from time to time. If we make changes, we will notify you by revising the date at the top of these Terms and, in some cases, we may provide you with additional notice. Your continued use of the Service after the revised Terms have become effective indicates that you have read, understood, and agreed to the current version of these Terms.

These Terms and any action related thereto will be governed by the laws of the State of California without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms will be the state and federal courts located in San Francisco County, California, and you waive any objection to jurisdiction and venue in such courts.
